Last updated: February 2026. These documents govern your use of Montarae Pro and explain how we handle your data and assets.

Terms & Conditions

1. Acceptance of Terms By accessing or using Montarae Pro ("we", "us", "our", "the Company") and its services (the "Platform"), you ("Client", "you") agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Platform.

2. Eligibility You must be at least 18 years of age (or the age of majority in your jurisdiction) and have full legal capacity to enter into binding contracts. The Platform is not available to residents of the United States of America (Sanctions Lists), Cuba, Iran, North Korea, Syria, the Crimea region, Donetsk, or Luhansk regions.

3. Account Registration You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. We may decline any application or close any account at our sole discretion in accordance with applicable laws (AML, CFT, sanctions screening).

4. Trading & Financial Products The Platform allows trading in Contracts for Difference (CFDs), spot crypto, indices, commodities, forex, and other complex financial products. These products carry a high level of risk because leverage can work both to your advantage and disadvantage. You may lose all of your invested capital. You should never invest money that you cannot afford to lose.

5. Order Execution Orders are executed at prevailing market prices using straight-through processing where available. Slippage may occur during high volatility. Stop-loss orders are not guaranteed unless explicitly marked as "Guaranteed Stop" with applicable premium fees.

6. Fees, Spreads & Charges You agree to pay all fees, spreads, swap charges, overnight financing costs, withdrawal fees, and any taxes applicable in your jurisdiction. Fee schedules are published on the Platform and may be updated with 14 days' notice.

7. Deposits & Withdrawals Deposits are credited only after on-chain confirmation (for crypto) or bank settlement. Withdrawals are processed within 24 business hours of admin approval, subject to KYC verification. The Company reserves the right to delay withdrawals pending compliance review.

8. KYC and AML You agree to provide identification documents (passport, national ID, or driver's license) and proof of address upon request. The Company complies with the Financial Action Task Force (FATF) standards. Failure to complete KYC may result in account restrictions, suspension, or termination.

9. Prohibited Conduct You must not: (a) engage in market manipulation, wash trading, or price manipulation; (b) use the Platform for money laundering, terrorism financing, or any illegal purpose; (c) attempt to reverse engineer, decompile, or breach security of the Platform; (d) operate multiple accounts to circumvent limits or bonuses; (e) use automated systems other than those expressly permitted.

10. Account Suspension and Termination We may suspend or terminate your account at any time, with or without notice, if we suspect a breach of these Terms, fraudulent activity, or for compliance reasons. Suspension may freeze open positions and pending withdrawals pending investigation.

11. Limitation of Liability To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of your use of the Platform. The Company's aggregate liability shall not exceed the fees paid by you in the preceding 12 months.

12. Indemnification You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, losses, or damages arising from your breach of these Terms or your use of the Platform.

13. Governing Law These Terms are governed by the laws of the United Kingdom (London) and any dispute shall be resolved in the courts of London. EU residents retain protections under their local consumer law.

14. Amendments We may modify these Terms at any time. Material changes will be announced with 30 days' notice via email and Platform notification. Continued use of the Platform after the effective date constitutes acceptance.

Privacy Policy

Introduction Montarae Pro ("we", "us", "our") respects your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, store, and share your information in compliance with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), the UK Data Protection Act 2018, and other applicable laws.

Data We Collect - Identity data: name, date of birth, nationality, photo ID, signature - Contact data: email, phone, residential address - Financial data: bank/wallet details, transaction history, account balance - Technical data: IP address, device fingerprint, browser type, login timestamps - Behavioural data: trading activity, deposits, withdrawals, support interactions - Marketing data: communication preferences, opt-in/opt-out status

2. Legal Basis for Processing We process your data under the following legal bases: (a) contract performance — to operate your trading account; (b) legal obligation — to comply with AML, KYC, tax, and other regulations; (c) legitimate interest — fraud prevention, security, and platform improvement; (d) consent — for marketing communications, which you may withdraw at any time.

4. Data Sharing We share your data only with: (a) regulators and law enforcement, when required by law; (b) payment processors and banks; (c) liquidity providers (anonymized order flow); (d) cloud infrastructure providers (AWS, Cloudflare) bound by data processing agreements; (e) identity verification partners (Onfido, Jumio); (f) auditors and legal advisors. We never sell your personal data to third parties.

5. Data Retention - KYC documents: 7 years after account closure (regulatory requirement) - Transaction records: 7 years - Marketing data: until you opt out + 30 days - Technical logs: 12 months - Support tickets: 3 years

6. International Transfers Data may be transferred outside your country of residence to our offices in 16 jurisdictions. We use Standard Contractual Clauses (SCCs) for EU/UK transfers and only work with infrastructure providers certified under recognized frameworks (ISO 27001, SOC 2).

7. Your Rights You have the right to: (a) access your data; (b) rectify inaccurate data; (c) request erasure (subject to legal retention obligations); (d) restrict processing; (e) data portability; (f) object to processing; (g) withdraw consent; (h) lodge a complaint with a supervisory authority (e.g., ICO in the UK, CNIL in France).

8. Cookies and Tracking We use cookies for: (a) session management (strictly necessary); (b) analytics (PostHog, with your consent); (c) marketing (only with explicit opt-in). You can manage cookies via your browser settings or our cookie preferences center.

9. Security We implement bank-grade security including: AES-256 encryption at rest, TLS 1.3 in transit, ISO 27001 certified data centers, 2FA enforcement, biometric login (mobile), 24/7 SOC monitoring, and regular penetration testing.

10. Data Breach Notification In the event of a personal data breach likely to result in high risk to your rights and freedoms, we will notify you and the relevant supervisory authority within 72 hours.

11. Children's Privacy The Platform is not directed to individuals under 18. We do not knowingly collect data from minors. If you believe a minor has provided us with personal data, contact us immediately.

Risk Disclosure

General Risk Warning Trading in financial markets — including Contracts for Difference (CFDs), cryptocurrencies, forex, indices, commodities, and securities — carries a substantial risk of loss. You should not engage in trading unless you fully understand the risks involved and can afford to lose the capital invested.

Leverage Risk Leverage magnifies both gains and losses. A small adverse market movement can result in losses exceeding the initial margin deposited. While we offer negative balance protection on retail accounts, losses can still represent the full deposit on a single trade.

Market Risk Financial markets can be volatile. Prices may move sharply due to economic releases, geopolitical events, natural disasters, or sudden changes in sentiment. Gaps, slippage, and extreme volatility can result in execution at prices significantly different from those quoted.

Liquidity Risk In illiquid markets, you may be unable to close positions at desired prices. This is particularly relevant for small-cap stocks, exotic forex pairs, and small-cap cryptocurrencies.

Counterparty Risk Montarae Pro acts as principal in CFD trades. In the unlikely event of insolvency, client funds held in segregated bank accounts at tier-1 institutions are protected under applicable investor compensation schemes (FSCS in the UK up to £85,000; ICF in Cyprus up to €20,000).

Cryptocurrency-Specific Risk Cryptocurrencies are highly volatile and largely unregulated. Their value can fluctuate dramatically, and you may lose your entire investment. Cryptocurrencies are not legal tender in most jurisdictions and are not backed by any government, central bank, or commodity. Smart contract bugs, exchange hacks, and network forks may result in permanent loss of funds.

Technology Risk Online trading depends on internet connectivity, electronic systems, and third-party infrastructure. Service interruptions, latency, or system failures may prevent you from executing or closing trades in a timely manner.

Regulatory and Tax Risk Regulations applicable to CFDs, crypto, and other products change frequently and vary by jurisdiction. Tax treatment depends on your individual circumstances and may change. You are solely responsible for determining and paying any applicable taxes.

Past Performance Disclaimer Past performance of any strategy, expert trader, AI bot, or asset is not indicative of future results. Hypothetical or backtested performance does not reflect actual trading and may not account for slippage, fees, or market impact.

AML & KYC Policy

Anti-Money Laundering (AML) Commitment Montarae Pro complies with international AML and Counter-Terrorism Financing (CTF) standards, including the FATF Recommendations, EU AMLD5 and AMLD6, the UK Money Laundering Regulations 2017, the US Bank Secrecy Act, and equivalent legislation in all jurisdictions where we operate.

Customer Due Diligence (CDD) We perform CDD on every client at onboarding and on an ongoing basis. This includes: - Verifying identity using government-issued photo ID - Confirming residential address via utility bill or bank statement (≤ 90 days old) - Screening against international sanctions lists (UN, OFAC, EU, UK HMT) - Politically Exposed Person (PEP) checks - Source of funds verification for deposits ≥ $10,000

Enhanced Due Diligence (EDD) EDD is performed for high-risk clients including: PEPs, clients from high-risk jurisdictions (FATF grey/black list), clients with complex ownership structures, and clients with unusual transaction patterns.

Transaction Monitoring All transactions are monitored in real-time by our AML systems. Suspicious activity is escalated to our Money Laundering Reporting Officer (MLRO) and reported to the relevant Financial Intelligence Unit (FIU) where required by law.

Sanctions Compliance We do not provide services to residents of sanctioned countries or to individuals/entities on sanctions lists. Accounts found to be in breach will be frozen immediately.

Record Keeping All KYC documents and transaction records are retained for 7 years after account closure, as required by law.

Cooperation with Authorities We cooperate fully with law enforcement, regulators, and tax authorities. We may share information without notifying you when legally required.

Complaints Handling

How to File a Complaint If you have a complaint, please email support@montaraepro.com with the subject "Formal Complaint" and include: - Your full name and account ID - Description of the issue - Date(s) and time(s) involved - Supporting screenshots or documents - Desired resolution

Our Process 1. Acknowledgement within 1 business day 2. Investigation by our Compliance team within 5 business days 3. Written response within 15 business days 4. Escalation to the Head of Compliance if you are not satisfied with the initial response

Final Response If we are unable to resolve your complaint within 8 weeks, you will receive a final response letter outlining your right to escalate.

Records All complaints are logged, tracked, and reported quarterly to senior management and to our regulators as required.

Fee Schedule

Spreads - Major forex pairs (EUR/USD, GBP/USD): from 0.0 pips - Minor forex pairs: from 0.4 pips - Major crypto (BTC, ETH): 0.1% - Altcoins: 0.2% – 0.4% - US stocks: 0.05% spread - Indices: from 0.4 points - Gold (XAU/USD): from 0.25 points

Commissions - Standard account: spread-only, no commission - Pro account: 0.05% per side on crypto, $7 per lot on forex (with tighter spreads)

Overnight Financing (Swap) - Forex: based on interbank rates ± 0.25% – 0.40% - Crypto: 0.04% per day on leveraged positions - Indices: based on interbank rates ± 0.30% - Stocks: based on Fed Funds rate ± 0.40% - Triple swap charged on Wednesdays (Forex) to account for weekend rollover

Deposit Fees - USDT (BEP20): free - USDT (TRC20): free - BTC / ETH: free (network fees apply) - Express Card: 2.5% - Bank wire: $10 (typically credited within 1-3 business days)

Withdrawal Fees - USDT (BEP20): $1 - USDT (TRC20): $1 - BTC: 0.0002 BTC - ETH: 0.005 ETH - Card: 2.5% - Bank wire: $25

Inactivity Fee $10/month after 6 months of no trading activity (waived for accounts with balance ≥ $100).

Currency Conversion 0.5% above mid-market rate for non-USD deposits and withdrawals.

All fees are subject to change with 14 days' notice.
